The guys held in Guantanamo were never proven to be terrorists and severe torture was used on them that was against international law, and now Obama is saying that those who commited torture against the law are above the law and cannot get prosecuted. Those tortured either died, are released or in the process of getting released. I don't presume to know another person's mind, but my guess would be that these guys were not "rogues" acting on their own, they were following the lead of those higher up. Waterboarding is not defined as a form of torture. The soldiers at Gitmo did nothing wrong. They broke no laws.
